Terms of Service

Terms of service

These terms apply to every order placed on homartshelfs.com. Please read them before you buy. Placing an order means you accept them.

1. Who we are

This website is operated by HOMART LIMITED ("we", "us", "our"), a company registered in England and Wales under company number 15257354, whose registered office is 30 Uphall Road, Ilford, England, IG1 2JF, trading as Homart Shelfs. Contact: support@homartuk.com, 07868 375682.

2. Using this site

You may use this site to browse and to place orders for your own use or for your business. You may not use it unlawfully, attempt to interfere with it, scrape it systematically, or reproduce our photographs, text or product data without our written permission.

3. Products, dimensions and load ratings

We describe our products as accurately as we can. Dimensions are given in millimetres and are nominal: timber and manufactured boards carry small production tolerances, and natural timber varies in grain and colour between batches, so the item you receive may differ slightly in appearance from the photograph.

Stated load ratings are the manufacturer's safe working load for the shelf when correctly installed into a sound substrate using appropriate fixings, with the load distributed evenly. The rating is not a guarantee of what your wall will hold. Responsibility for choosing suitable fixings for your wall type, and for installing correctly, rests with you or your installer. See our load ratings and fixings guide.

4. Prices and payment

Prices are in pounds sterling and include VAT where applicable. Delivery charges are shown separately at checkout before you pay. We take payment at the time you place your order.

We try to keep prices and stock accurate but errors happen. If we discover a material pricing error or that an item is out of stock after you have ordered, we will contact you and give you the choice of confirming the order at the correct price or cancelling it for a full refund. We are not obliged to supply at an incorrect price.

5. When a contract is formed

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not form a contract. A contract is formed only when we send you a dispatch confirmation. If we cannot accept your order we will tell you and refund any payment in full.

6. Delivery and risk

Delivery timescales and charges are set out on our delivery page. Estimated delivery dates are estimates, not guarantees. Risk in the goods passes to you on delivery; ownership passes when we have received payment in full.

7. Cancellation, returns and faults

Your statutory cancellation rights and our returns procedure are set out in full on our returns and refunds page, which forms part of these terms.

8. Installation and safety

Our products are supplied for self-assembly and installation by a competent person. Where an item is intended to be secured to a wall, or where an anti-tip restraint is supplied, it must be fitted and used as instructed. We are not liable for damage or injury arising from incorrect installation, installation into an unsuitable substrate, use of fixings other than those appropriate for the wall type, or loading beyond the stated safe working load.

9. Liability

We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or under the Consumer Rights Act 2015.

If we fail to comply with these terms we are responsible for loss or damage you suffer that is a foreseeable result of our breach. We are not responsible for loss or damage that was not foreseeable. Where you buy as a business, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity, and our total liability to you in connection with an order is limited to the price of that order.

10. Events outside our control

We are not liable for delay or failure to perform caused by an event outside our reasonable control, including carrier failure, extreme weather, industrial action, or supply disruption. If such an event occurs we will contact you and may extend delivery timescales; if the delay is substantial you may cancel and receive a full refund.

11. Your account

If you create an account you are responsible for keeping your password confidential and for activity under your account. Tell us promptly if you believe someone else has accessed it.

12. Intellectual property

All content on this site, including the Homart Shelfs name and logo, product photography and descriptions, is owned by or licensed to us and protected by copyright and trade mark law.

13. Complaints

Email support@homartuk.com and we will acknowledge within two working days and aim to resolve within ten. If you remain unhappy you may contact Citizens Advice on 0808 223 1133.

14. Changes to these terms

We may amend these terms from time to time. The version in force when you place your order is the version that applies to it.

15. Governing law

These terms are governed by the laws of England and Wales, and disputes fall to the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
